I must commend you on your handling of this matter. You were very professional, and kept things very tidy...no confusion to your findings at all! I was vaguely familiar with this situation, but was more familiar with the legitimate theft over at the Polish site. Once again great job, and thanks for standing behind all modders, screen-shooters and their work.
When I was still playing Oblivion, the Loading screens were a must have mod for me. And Gal, always, maintained an very professional appearance where his mod was concerned. This is why I was a bit confused when the whole deal hit the fan.
And I know that Floy is a professional too, when it comes to modding. Maybe the theft of Floys pics over at the Polish site sparked this all somehow! Or just a misunderstanding!
I'm just glad that things are set straight; at least from the Permission side of things!
A case was opened at TESNexus regarding a theft accusation of Floydian's images in Galahaut's mod(s) called Atmospheric Dark UI Loading Screens. Research has shown that Galahaut does in fact have permission to include screenshots by Floydian prior to June 5, 2008. The latest image included is dated April 13, 2008 and no action will be taken against Galahaut. Any further accusations about this subject will not be tolerated. According to our rules, this matter is closed and not up for public debate.
Floydian contacted Galahaut on Aug 27, 2008 and asked that all his images be purged from his mod. Galahaut refused because work was already performed based on permissions already given. Floydian then requested that no further work be done including his images. Galahaut agreed that he would no longer add additional images and would delete the screenshots he had to ensure new images by Floydian would not be added in his mods. Galahaut released an update to his mod on Sept 28, 2008 that was in the works for some time but it did not matter to Floydian that Galahaut included nothing new of Floydians that was not already in the original mod. At this point, Floydian began a slander campaign along with friends that could post where he could not rather than letting TESNexus administrators handle the report.
The staff at TESNexus will stand by any author (banned or otherwise) that has not given their permission for their work to be used in other mods but will not support a decision by an author to retroactively revoke permissions already given. Imagine if Bethesda were given permission by a third-party vendor to include content in Oblivion and then they withdraw permission for use in Oblivion after it was released demanding a recall of the product. This would not happen unless there was an epic breach of contract. Similarly, the vendor cannot withdraw their permission if the game is updated, patched, or add-ons are made available for the game that build on the original work.
