That is true, when it comes to high % of pickpocket and "cheating".
However, if we assume that you're a grandmaster pickpocket trying to pickpocket an innocent guard of his Ale, from behind the darkness, while he's sleeping, and you still have 1 / 10 to get caught .. I think that's not fair chances.
Moreover, when you have 0% chances to steal something, even if you're the same grandmaster, its not fair either. The guy has 3000 gold on him? 1% chance, without any +pickpocket gear on you. The guy has 4000 gold? Continuous 0% chances, with all +pickpocket gear and buffs, and even if you're the best pickpocket in the realm.
