god I wish I could mod it into vendor levelled lists or perhaps leave them in different locations so I could scavenger hunt for them rather than just get them out of a box. may have to teach myself to use the creation kit...
Certainly, that's true. If RedBadger can confirm each song they use is on the public domain (from a reputable source, of course, including links related to each specific version of the song used) that would be great
I know for a fact some of them are NOT in the public domain, though, so it's always best to thread carefully. Or just make it necessary for users to unpack the song from the older games themselves and only offer the esp. That would be the safest course of action, methinks.
i don't think any of the songs are public domain, and even if one version of a song was, the version used in the game might not be - for example, many of the diamond city radio versions aren't the originals, but different kinds of alt studio slices / mixes which will all have their own copyright and the same will likely be the case for songs from the older games.

But please don't upload any music files taken from the older games, as that could be counted as ported content
