As persistant distraction is a passive ability it's deflection malus from distracted stacks with other penalties to deflection from active sources, like stunned, however in a scenario that an enemy is affected by persistant deistraction then stunned, and then e.g. blinded it's deflection is gonna jump up and down.

This issue became apparent to me when investigating issues with how confounding blind works and how it stacks with -10 malus from flanked.
As effects from active abilities, stack with effects from passive abilities, but not with other active ones this creates a strange problem.
In a situation when you engage an enemy, applying persistent distraction he becomes flanked and suffers -10 Def, if you then stun him, it will stack to -20Def. However, if you then blind the enemy e.g chilling fog or confounding blind, his deflection will jump back to -10 as the blinded affliction will supersede the distracted affliction, and as it comes from an active ability it will not stack. Causing the enemy's deflection to "fluctuate"
This is a simple fix, it disables the stacking of persistand distraction completely, as after a discussion on forums it was the cleanest option and the one that keeps things balanced.
