I know this is an extremely old post of yours... but I figured in the off chance someone (or yourself) is running into the same issue - as I did as well initially - then I figured I'd post what I did to fix the matter.
When you are running the .exe (as you MUST install this manually, you cannot use the Nexus Mod Manager) you must manually direct the program to the Steam Apps > Common > Oblivion > Data folder, you cannot copy+paste the directory and expect the program to recognize the path nor can you just point it to the core Oblivion folder; you MUST point the program to the Oblivion > Data folder for it to patch or it will not work and you will receive the above mentioned error.
I'm following the Oblivion Beautification guide here (http://www.skyrim-beautification-project.com/oblivion/mods/index.htm) but even they failed to mention that and they stated the guide must be followed to the "T"... funny that no one thinks this tiny detail was important back then. xD
Also, don't install games like Oblivion into your "Program Files" folder; it's an OS protected directory and keeping Oblivion in this folder will likely cause future mod headaches.
I died numerous times when the insta-kill script was reflected back on me. I googled several things trying to find a simple solution and this file was the only solution that I found.
I was far into the game and didn't want to restart my character, so I prayed your patch would work without needing one. It did!
I can't comment on the leveled items change made as I already had the items, but I can say that the reflected insta-kill bug is fixed 100% ... no need to even start a new game for it to take effect.
